Foulks faces $2 million suit for wrongful death

Camellia Foulks’ cousin is waiting for a hearing date on a $2.07 million lawsuit for the deaths of her children, although her lawyers say they are uncertian such a hearing will ever take place.

Cecilia Sanders McDaniel is seeking to recover three types of damages for each of her four children killed in an August 94 blaze at Foulks’ home. Three of Foulks’ children also died in the fire.

Patricia Littleton, co-counsel for McDaniel, said she is uncertain as to whether prosecution will get a hearing, because they have been requesting one for some time and Foulks does not have council.

In court Monday, Littleton discussed possible hearing dates with Judge William Schwartz.

The judge said he would get back to us, Littleton said. If anything, it will be a hearing on the damages, Littleton said.

McDaniel’s other attorney, G. Patrick Murphy, said in March that he did not expect Foulks to be able to pay the damages if she loses the lawsuit. He said the only way they can expect to recover damages is if the house is covered by liability insurance.

Littleton said Foulks’ insurance company denied coverage.

McDaniel alleges the deaths of her children were wrongful, and seeks $500,000 per child. She asks for $15,000 for the conscious pain and suffering each child suffered before dying in the fire, and $3,000 per child to cover funeral and burial expenses.

Foulks also faces charges in a Jackson County criminal case. She is charged with eight counts of involuntary manslaughter, one count of reckless conduct and one count of endangering the life or health of a child.

Police say Foulks left the children alone while she went to a liquor store and bar. Officials also say the fire was started by one or more of the children playing with matches or a lighter.

Foulks’ next criminal case hearing is at 1 p.m. on November 9.
